LEASE VEHICLE CONTRACT № ____

LLC “Asia Expeditions” represented by Director Kharov Arlan acting on the basis of Charter hereinafter referred to as Lessor on the one part and (Name)_______, passport № _______hereinafter referred to as Lessee on the other part, have concluded this Contract for the following:

 

 

1. Contract Subject

1.1. Under this Contract Lessor transfers to Lessee the vehicle stated in item 1.2. for temporary possession and usage on terms reflected below.

1.2. Vehicle characteristics: model: _______, year of made 20_____

1.3. Territorial limit is Kyrgyz Republic

1.4. At the reservation of liability under this Contract the Lessee is allowed to transmit driving to following people:

1. Terms of Payment

2.1. The rent is _____ USD per day and total amount is _____ USD for all period

2.2. At the moment of rent payment Lessee has to pay guarantee fee at the rate of 500 USD, providing fulfilling of Lessee’s liabilities under this Contract and damage recovering if established. The guarantee fee shall be returned to Lessee at the end of Contract validity term under the fulfilling all of the Contract items. But in case if Lessee commits unlawful acts to the vehicle (such as: car theft, selling, pawn, or vehicle transfer to a third party) – the amount of the guarantee fee is non-refundable.

2.3. In case of pre-termed cancel of this Contract by Lessee the Lessor is entitled to deduct 30% of rent being subject to returning to the Lessee.

3. Contract terms

3.1. The Lessor transfers to the Lessee the vehicle reflected in item 1.2. for temporary possession under the payment stated in item 2.1 The records of the rented vehicle technical state, its outside and inside appearance are reflected by Parties in the Delivery-Acceptance report which is the essential part of this Contract. In case of any changes of vehicle state, intactness or other characteristics reflected in the original Delivery-Acceptance report at the moment of vehicle returning, the Parties note the cost of damages and the other charges cost in the Delivery-Acceptance report, which the Lessee shall reimburse to restore the vehicle.  The Delivery-Acceptance report is the argument to deduct proper amount from the guarantee fee. 

3.2. The Lessee has the right to ask the Lessor to transfer him a vehicle in a proper technical state meeting all the terms of the present Contract and also transfer him all necessary documents for the rented vehicle.

3.3. The vehicle is insured at the expense of Lessor. The vehicle insurance foresees implicit deductible (excess).Implicit deductible is the cost of damage not covered by Insurance Policy in case of vehicle injuries. The deductible at the rate of (guarantee fee) 500 USD is the maximal sum of Lessee’s obligations if the occurred damages are covered by Insurance Policy.

In the case of vehicle physical loss, the Lessee is obliged to pay to the Lessor a fee at the rate 10% from full cost of the car (full cost mentioned in Liability)

The Lessee must pay the cost of transporting the damaged vehicle.

3.4. The Lessee is responsible for injury or damages caused to third party’s life, health and property as a result of vehicle operation only in that part which exceeds the sum of maximum limit of liability for bodily injury and property damage reflected in Insurance Policy. 

3.5. The Lessee independently, at his own expense and in full, bears all costs caused to his life and passengers’ health, and also responsible for damages caused to baggage being in the vehicle and belonging to Lessee or one of the passengers or being in use at the moment of vehicle rental period.  

3.6. The Lessee shall return the vehicle in full complete stated in the Delivery-Acceptance report.

3.7. The component parts of the vehicle are not insured. The Lessee is responsible for casual loss or damage of component parts noted in the Delivery-Acceptance report. The Lessee financially accounts for absence, damage or other rebukes to component parts. The financial liability of Lessee is determined by the Lessor on the ground of the component parts documented costs. 

3.8. In case of more then 4 hours’ delay to return the vehicle, according to the item 4.1 of this contract, Lessee pays to Lessor sum at the rate of day rent. The Lessor is entitled to deduct that sum from guarantee fee.

3.9. In case of more than 24 hours’ delay to return the vehicle, Lessor has right to address to Inner Affairs Bodies with Statement about vehicle theft.

3.10. The Lessor is not allowed to transmit driving to people not reflected in item 1.4. of this Contract.

3.11. From the moment of signing the Delivery-Acceptance Report Lessee accounts for damages or physical loss of vehicle as the result of events not covered by Insurance Policy and also is obliged to indemnify under the Lows of Kyrgyz Republic for damages and injuries caused by vehicle to third party.

3.12. The Lessee shall return the vehicle clean interior and exterior otherwise is responsible for damages revealed at Service Maintenance Station.  

3.13. The Lessee shall return the vehicle with the same quantity of fuel as at the moment of receipt. Otherwise the Lessee has to pay for the lack of fuel according to the Delivery-Acceptance report. 

3.14. Under the breach of items 1.4. and 3.9. of this contract the Lessor is entitled to deduct the guarantee fee stated in the item 2.2. of the Contract. 

4. Contract validity term

4.1. The contract enters into force at the moment of Lessee’s fulfilling the items 2.1. and 2.2. of this Contract and valid

From______2020 to _____2020 and can be prolonged by the consent of the Parties.

If the contract is prolonged on the same conditions the Parties make a note in item 4.2. of this Contract.

4.2. The contract is prolonged:

4.3. The Contract shall be prolonged during 4 hours from the moment of contract termination stated in item 4.1. of this Contract

5. Lessee’s Liability

5.1. Under not fulfilling the item 4.3. of the contract the Lessee shall pay double-rate rent for every expired day.

 

6. Procedure in the event of accidents

6.1.  In case of accident the Lessee must:

6.1.1. Not move the vehicle being the participant of the accident;

6.1.2. Immediately inform the representatives of Lessor and Insurance Company;

6.1.3. Inform the police and ask for the name, addresses and phone numbers of other people involved and any witnesses

6.2. In case of damages caused by actions of third persons (theft, hijacking and so on) the Lessee must:    

6.2.1. Immediately inform the representatives of Lessor.

6.2.2. In common with Lessor representatives address to Inner Affairs Bodies with the Statement about occurred event.

6.3. Matters not adjusted by this contract are settled by Low of Kyrgyz Republic.

6.4. Any alterations or additions to this contract are supposed to be completed in written form and signed by representatives of Parties.

6.5. This contract is drawn in 2 copies, one copy for each Party, both copies being equally valid.

6.5. In the event of the evacuation of the vehicle due to stock or damage to any parts of the car caused by the fault of Lessee, the Lessee is obligated to pay the full cost of evacuation and repair of damaged parts of the car.

6.5.1 The Lessee shall not have the right to leave the vehicle, which required to be evacuated without the prior consent and agreement of the Lessor.

 

7. Other regulations

7.1. In the event of damage to the car is not an insurance case, the tenant is obliged to compensate the Lessor the full amount of damage.

7.2. Smoking is prohibited in the car, in the case of damage interior by cigarettes or tobacco-specific odor Lessee agrees to pay for the interior repair or interior cleaning.  

7.3. Cars are not intended to drive off-road and should be used only on prepared public roads. Damage due to off-road driving must be paid for by the Lessee.

7.4. It is prohibited to use the cars for driving through difficult terrain and badly damaged roads. For example, the road to the                 “Altyn Arashan”. In case of violation of this paragraph, the deposit is not refunded to the Lessee.

7.5. It is prohibited to use cars for driving deep rivers (where there is a possibility of engine damage for example road to the Kol-Suu lake) and other water obstacles fording. In case of violation of this paragraph, the deposit is not refunded to the Lessee.

7.6. Mountain territory of the Kyrgyz Republic has no cellular coverage; the Lessor shall not be liable to the Lessee if the latter os unable to report on the emergency situation. In this regard, we recommend the use a satellite phone. 

7.7. Insurance is not valid if the drivers experience less than 3 years

7.8. In the event of items violation of this agreement by lessee, the contract can be terminated unilaterally by Lessor. The Lessor has the right to withhold the full value of the deposit and the balance of the rent payment amount without any compensation to the Lessee.

7.9. Strictly prohibited to consume any alcohol or narcotics. Kyrgyzstan has a zero-tolerance policy toward driving under influence of alcohol or narcotics. In the event of damage to the car while alcohol or narcotics are present in Lessee system in any amount that Lessee liable for the total value of damage to the car as well as lost income from the car.

 

The signing of this contract is the evidence of Lessee examination and consent with Conditions of Vehicle Leasing
